How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Q.1: Answer each of the following questions in 2
two · or 3 (three) sentences (20 Marks - 2 marks each)
Answer
Section 2(d) of the Maharashtra Stamp Act, 1958 (called the Bombay Stamp Act until Mah. 24 of 2012) defines "chargeable" as follows. For an instrument executed or first executed after the commencement of the Act, it means "chargeable under this Act". For any other instrument, it means chargeable under the law in force in the State when the instrument was executed. Where several persons executed it at different times, the relevant date is when it was first executed.
What makes an instrument chargeable (section 3). An instrument mentioned in Schedule I is chargeable with the duty shown there if:
Instruments executed by or for the Government, where the Government would otherwise pay, are exempt (proviso to section 3).
Why it matters. Only a chargeable instrument must be "duly stamped". An instrument "chargeable with duty" that is not duly stamped cannot be admitted in evidence, acted upon or registered until duty and penalty are paid (section 34).
Example. A conveyance of a flat in Pune executed in 2018 is chargeable under Article 25 of Schedule I at the rates then in force.
