The Paper as Set

The questions in this volume are the questions asked at the May 2015 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: (1) All questions are compulsory. (2) Figures to the right indicate full marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is a farming Society?[2]

Answer

Section 2(12) of the Maharashtra Agricultural Lands (Ceiling on Holdings) Act, 1961 defines a "farming society" as "a society registered or deemed to be registered as such, under any law for the time being in force relating to the registration of co-operative societies". It is a co-operative society formed for farming, registered today under the Maharashtra Co-operative Societies Act, 1960.

A joint farming society is a special kind. Section 2(15) defines it as one "the members of which cultivate jointly the land held by the members or by the society". The members pool their land and farm it as one unit.

Why it matters.

  1. Ceiling. Land held by a co-operative society is not ignored. Each member's share of it is counted in his own holding, in proportion to his share in the society (section 3(3)(b) and (ii)).
munotes.in 2
  1. Distribution of surplus land. The State may grant surplus land to a joint farming society (section 28). Surplus land once held by a farming society goes first to a person the society undertakes to admit as a member (proviso to section 27(5)).
  2. Tenancy Act. Under the Maharashtra Tenancy and Agricultural Lands Act, 1948, a co-operative farming society is one registered under the co-operative societies law (section 2(4)). A landlord cannot end a tenancy for personal cultivation while the tenant is a member of such a society (section 31B(3)). A society of agricultural labourers, landless persons or small holders comes first in the priority list for sale of land (section 32P(2)(c)).
