How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Q.1: Answer in 2-3 sentences each
20 Marks - 2 marks each
Answer
Section 3(ee) of the Land Acquisition Act, 1894 says "the expression 'appropriate Government' means, in relation to acquisition of land for the purposes of the Union, the Central Government, and, in relation to acquisition of land for any other purposes, the State Government". It was inserted by the Adaptation of Laws Order, 1950.
The test is the purpose, not the place.
What the appropriate Government does. It issues the preliminary notification (section 4) and the declaration (section 6). It may invoke urgency (section 17), and it approves the Collector's award unless approval is dispensed with (section 11). Its decision on objections is final (section 5A).
Under the 2013 Act. Section 3(e) of the Right to Fair Compensation Act, 2013, in force from 1 January 2014, defines the term more fully:
For a public purpose in a district up to a notified area, the Collector is deemed to be the appropriate Government (proviso).
