How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Q.1: Answer in 2 to 3 sentences each
Answer
In land acquisition law the term is "person interested". Section 3(x) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 says it means:
The older definition. Section 3(b) of the Land Acquisition Act, 1894 covered only the first and third classes. The 2013 Act adds forest dwellers, tenants, share-croppers and those whose livelihood is hit.
What a person interested may do. He gets notice of the enquiry (section 21), and may object to the measurements and the value. He shares in the apportionment of the award (section 23). If he does not accept the award, he may seek a reference to the Authority (section 64).
Case law. In Himalayan Tiles and Marble (P) Ltd. v. Francis Victor Coutinho (1980) 3 SCC 223, land was acquired for a private company. The company was held to be a "person interested". The Supreme Court said the inclusive definition must be read liberally, to cover anyone interested in the title or the amount of compensation.
