(a)What is the meaning of Welfarism?[2]

Answer

A welfare State is one that takes positive responsibility for the material wellbeing of its people. It does not merely keep order and collect revenue. It provides or regulates education, health, housing, employment, social security, food and power, and it intervenes in the economy to reduce inequality.

Its opposite is the police State, also called the laissez faire or night watchman State, whose functions are limited to order, revenue and defence, and which leaves everything else to the individual and to the market.

Its features.

  1. Positive obligations, so the citizen has entitlements and not only freedoms.
  2. A very large administration, because someone must run the schools, the hospitals and the ration shops.
  3. Wide discretion, because who gets a licence, an allotment or a subsidy varies case by case.
  4. Economic intervention, through planning, regulation, public undertakings and redistribution.

India is a welfare State, and the Constitution says so in substance.

  1. The Preamble promises social, economic and political justice.
  2. The Directive Principles state the obligations. Article 38, a social order in which justice informs all the institutions of national life. Article 39, adequate means of livelihood and distribution of material resources to subserve the common good. Article 41, the right to work, to education and to public assistance. Article 43, a living wage. Article 47, the duty to raise nutrition and public health.
  3. Kesavananda Bharati v. State of Kerala (1973) 4 SCC 225 and later cases read the Directive Principles and the fundamental rights together.

Conclusion. A welfare State is one that accepts responsibility for the wellbeing of its people, and India is one by constitutional design. For this subject the point is that the welfare State is the reason administrative law exists. The State that does more must be given more power, and that power has to be controlled.
