The Paper as Set

The questions in this volume are the questions asked at the May 2025 - ATKT 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.State any two instances of Grievous Hurt.[2]

Answer

Section 320 of the Indian Penal Code, 1860 is now section 116 of the Bharatiya Nyaya Sanhita, 2023. Only eight kinds of hurt are "grievous". Two instances are these.

1. Permanent loss of sight of either eye (clause (b)). Example: A throws acid at B's face and B permanently loses the sight of one eye.

2. Fracture or dislocation of a bone or tooth (clause (g)). Example: A hits B with an iron rod and breaks his arm.

All eight kinds.

  1. Emasculation.
  2. Permanent loss of sight of either eye.
  3. Permanent loss of hearing of either ear.
  4. Loss of any member or joint.
  5. Destruction or permanent impairing of the powers of any member or joint.
  6. Permanent disfiguration of the head or face.
munotes.in 2
  1. Fracture or dislocation of a bone or tooth.
  2. Any hurt which endangers life, or causes severe bodily pain or inability to follow ordinary pursuits for fifteen days.

The Sanhita's change. In the eighth clause, the Code required twenty days. The Sanhita reduces it to fifteen days.

Strict proof. In Mathai v. State of Kerala, AIR 2005 SC 710, the Supreme Court said each kind of grievous hurt "must be strictly proved". Medical evidence is needed. A hurt outside the eight kinds, however painful, is simple hurt under section 114.

Punishment. Voluntarily causing grievous hurt carries up to seven years, and fine (section 117(2)). If a dangerous weapon is used, life, or one to ten years, and fine (section 118(2)).
