The Paper as Set

The questions in this volume are the questions asked at the Dec 2018 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Answer in not more than two sentences, all 10 20 Marks

munotes.in 1

1.Name any two members of the law commission which drafted the Indian Penal Code.[2]

Answer

The Indian Penal Code, 1860 was drafted by the First Law Commission, appointed in 1834. Two of its members were these.

1. Thomas Babington Macaulay. He was the president of the Commission. The draft is largely his work, and the Code is often called "Macaulay's Code".

2. Macleod. He was one of the members, along with G.W. Anderson and F. Millett. They were civil servants drawn from the presidencies.

The history.

  1. The Commission was appointed in 1834.
  2. It submitted the Draft Penal Code in 1837.
  3. The draft was revised over the following years.
  4. It was passed as Act XLV of 1860, and came into force on 1 January 1862.

What Macaulay aimed at. He wanted a code that was complete, uniform and written in plain language. He added illustrations under most sections, so that a magistrate in a district town without a law library could apply it. These illustrations are still found in the Sanhita.

Its replacement. The Indian Penal Code was repealed by section 358(1) of the Bharatiya Nyaya Sanhita, 2023. The Sanhita came into force on 1 July 2024. Much of Macaulay's structure and many of his illustrations survive in it.

Its long life. The Code governed Indian criminal law for more than 160 years, from 1862 until 2024. It was amended many times in between, for example in 1983 and 2013 on sexual offences.

Sources differ on one name. Some accounts also list C.H. Cameron. All agree that Macaulay led the Commission and wrote most of the draft.
