How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Answer
Section 21 of the Indian Penal Code, 1860 is now section 2(28) of the Bharatiya Nyaya Sanhita, 2023. "Public servant" means a person falling under any of the descriptions it lists. The main ones are these.
Appointment does not matter. A person falling within a description is a public servant whether appointed by the Government or not (Explanation (a)).
Defective title does not matter. A person in actual possession of the post is a public servant. Any legal defect in his right to hold it does not matter (Explanation (b)).
Illustration. A Municipal Commissioner is a public servant.
Why it matters. Many offences protect or bind public servants, such as assaulting a public servant to deter him from duty (section 132).
