How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Answer in not more than two sentences, all 10 20 Marks
Answer
Section 107 of the Indian Penal Code, 1860, defines it. The section is now section 45 of the Bharatiya Nyaya Sanhita, 2023.
A person abets the doing of a thing in three ways.
Two Explanations matter. Explanation 1 deals with instigation. A person may wilfully misrepresent or conceal a material fact which he is bound to disclose. If he thereby voluntarily causes a thing to be done, he is said to instigate it. Explanation 2 deals with aid. A person who does anything to facilitate the commission of an act is said to aid it. This covers acts done before the offence as well as at the time of it.
The abettor is liable whether or not the offence follows. Section 115, now section 55, punishes abetment of an offence punishable with death or imprisonment for life where the offence is not committed. The person abetted need not even be capable of committing the offence.
