The Paper as Set

The questions in this volume are the questions asked at the May 2024 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.State any two instances when the right of private defense of the body can extend to the causation of death.[2]

Answer

Section 100 of the Indian Penal Code, 1860, is the section to cite. It is now section 38 of the Bharatiya Nyaya Sanhita, 2023. It says when the right of private defence of the body extends to causing death. It lists seven descriptions of assault. The right is always subject to the restrictions in section 99, now section 37. Any two of the following may be given.

  1. An assault reasonably causing the apprehension that death will otherwise be the consequence.
  2. An assault reasonably causing the apprehension that grievous hurt will otherwise be the consequence.
  3. An assault with the intention of committing rape.
  4. An assault with the intention of gratifying unnatural lust.
  5. An assault with the intention of kidnapping or abducting.
munotes.in 2
  1. An assault with the intention of wrongfully confining a person, where he reasonably fears he cannot reach the public authorities.
  2. An act of throwing or administering acid which may reasonably cause the apprehension of grievous hurt.

Where the question asks about property, the section is 103, now section 41. It allows death to be caused against robbery. It also allows it against house-breaking by night, and against mischief by fire on a dwelling. The fourth case is theft, mischief or house-trespass causing a reasonable apprehension of death or grievous hurt.
