The Paper as Set

The questions in this volume are the questions asked at the May 2012 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Answer in not more than two sentences, all 10 20 Marks

munotes.in 1

1.What is wrongful confinement?[2]

Answer

Section 340 of the Indian Penal Code, 1860, defines it. The definition is now section 127(1) of the Bharatiya Nyaya Sanhita, 2023.

"Whoever wrongfully restrains any person in such a manner as to prevent that person from proceeding beyond certain circumscribing limits, is said wrongfully to confine that person."

There are two ingredients.

  1. There must be a wrongful restraint, as defined in section 339, now section 126(1).
  2. The restraint must prevent the person from going beyond certain circumscribing limits, so that he is kept within a defined boundary.

The Code's own illustration makes it plain. A causes Z to go within a walled space and locks Z in. Z is thus prevented from proceeding in any direction beyond the circumscribing line of the wall. A wrongfully confines Z.

munotes.in 2

The difference from wrongful restraint. Wrongful restraint is defined by section 339, now section 126(1). It is the voluntary obstruction of a person, so as to prevent him proceeding in any direction in which he has a right to proceed. Wrongful confinement keeps him within limits on every side. Confinement is therefore a species of restraint, and every wrongful confinement includes a wrongful restraint.

Punishment. Section 342 punished wrongful confinement with imprisonment up to one year, or fine up to one thousand rupees, or both. The Sanhita's section 127(2) keeps the one year but raises the fine to five thousand rupees. Confinement for three days or more carries up to three years under section 127(3).
