The Paper as Set

The questions in this volume are the questions asked at the Nov 2011 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Answer in not more than two sentences, all 10 20 Marks

munotes.in 1

1.Define Wrongful Loss and Wrongful Gain.[2]

Answer

Both are defined by section 23 of the Indian Penal Code, 1860. The definitions are now in sections 2(36) and 2(37) of the Bharatiya Nyaya Sanhita, 2023.

Wrongful gain is "gain by unlawful means of property to which the person gaining is not legally entitled".

Wrongful loss is "the loss by unlawful means of property to which the person losing it is legally entitled".

Two elements run through both. There must be unlawful means, and the question of legal entitlement decides which side a person is on.

The section goes on to explain gaining and losing wrongfully. A person gains wrongfully not only when he acquires property, but also when he retains property he is not entitled to keep. A person loses wrongfully not only when he is deprived of property, but also when he is kept out of property he is entitled to.

munotes.in 2

Why the definitions matter. They are the foundation of the word dishonestly. Section 24 defines it. A person acts dishonestly who does anything with the intention of causing wrongful gain to one person, or wrongful loss to another. "Dishonestly" is in turn the mental element of theft, misappropriation, criminal breach of trust and cheating. So these two definitions run through the whole of the chapter on offences against property.
