The Paper as Set

The questions in this volume are the questions asked at the Apr 2011 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Answer in not more than two sentences, all 10 20 Marks

munotes.in 1

1.State the ingredients of Dowry Death.[2]

Answer

Section 304B of the Indian Penal Code, 1860 is now section 80 of the Bharatiya Nyaya Sanhita, 2023. A death of a woman is a "dowry death" when its ingredients are met. The husband or relative is then deemed to have caused her death.

The ingredients.

  1. The death of a woman, caused by burns or bodily injury, or occurring otherwise than under normal circumstances.
  2. The death occurs within seven years of her marriage.
  3. Soon before her death, she was subjected to cruelty or harassment.
  4. The cruelty or harassment was by her husband or any relative of her husband.
  5. It was for, or in connection with, a demand for dowry.

Dowry. It has the meaning in section 2 of the Dowry Prohibition Act, 1961. It is any property or valuable security given or agreed to be given in connection with the marriage.

Punishment. Imprisonment of at least seven years, which may extend to life (section 80(2)).

munotes.in 2

The presumption. It must be shown that soon before her death the accused subjected her to cruelty or harassment for dowry. The court shall presume that he caused the dowry death (section 118 of the Bharatiya Sakshya Adhiniyam, 2023).

Cruelty distinguished. In Shanti v. State of Haryana, AIR 1991 SC 1226, the Supreme Court held that dowry death and cruelty are distinct offences. Both may be charged together.

Example. A woman dies of burns at her in-laws' house three years after marriage. A week earlier they beat her for not bringing more money from her parents. It is a dowry death.
