The Paper as Set

The questions in this volume are the questions asked at the May 2026 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.Define "Intestate" under the Indian Succession Act.[2]

Answer

An intestate is a person who dies without making an effective will for his property.

The rule: section 30. Under the Indian Succession Act, 1925, a person dies intestate in respect of all property he has not effectively disposed of by will. The disposition must be capable of taking effect.

The illustrations show four cases.

  1. He left no will at all. He dies intestate for the whole estate.
  2. His will only appointed an executor and gave nothing away. He dies intestate for its distribution.
  3. He gave his whole property for an illegal purpose. The gift fails, and he dies intestate.
  4. One of his gifts failed because the legatee died first. He dies intestate for that part.

Total and partial intestacy. A person may be wholly intestate, or partly intestate where some property is not effectively disposed of.

What happens to the property. It passes under the rules of intestate succession.

  1. Christians and others: Chapter II of Part V of the Act.
  2. Parsis: Chapter III of Part V.
  3. Hindus, Buddhists, Sikhs and Jainas: the Hindu Succession Act, 1956.
  4. Muslims: Muslim personal law.

Who administers the estate. There is no executor, so the court grants letters of administration to an administrator (section 2(a)).

Example. Thomas, a Christian, dies leaving no will, a widow and two daughters. He is an intestate. The widow takes one-third, and the daughters share two-thirds equally.
