The Paper as Set

The questions in this volume are the questions asked at the May 2025 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Q1. Answer the following in Two sentences

Any Six · , any 6 of 8 12 Marks

munotes.in 1

1.Who is a Muslim?[2]

Answer

A Muslim is a person who professes the religion of Islam. In essence, he accepts the unity of God and the prophethood of Muhammad.

The leading case. In Narantakath Avullah v. Parakkal Mammu (Madras, 1922), the question was whether the Ahmadis were Muslims. The High Court held that they were.

  1. They accepted the Kalma, the prophethood of Muhammad and the authority of the Quran.
  2. These are "the essential conditions for a person to be a Mahomedan".
  3. Krishnan J. quoted Ameer Ali: any person who professes Islam, accepting the unity of God and Muhammad's prophetic character, is a Muslim.

Differences of doctrine do not matter. A person does not stop being a Muslim because he belongs to a sect with views different from the orthodox. In that case, the husband's adoption of Ahmadi beliefs did not make him an apostate.

Two ways of becoming a Muslim.

  1. By birth, to Muslim parents.

  1. By conversion, by professing Islam.

The court does not test sincerity or observance. What matters is the profession of faith, not how strictly a person practises.

Why it matters. Under section 2 of the Shariat Application Act, 1937, Muslim personal law governs listed matters "where the parties are Muslims".

Ceasing to be a Muslim. A married Muslim woman who renounces Islam is not thereby divorced. Section 4 of the Dissolution of Muslim Marriages Act, 1939 says so, with exceptions.

Example. A man born a Hindu who sincerely professes Islam becomes a Muslim, and Muslim personal law then governs him.
