The Paper as Set

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Multiple Choice Questions of 1.5 Marks each, all 20

munotes.in 1

1.Muhammadan (Islamic) Law applies ONLY to: (a) Muslims by birth (b) Muslims by choice (Conversion) (c) Muslims by birth or by choice (d) Muslims by birth but not by choice

Answer

The answer is (c), Muslims by birth or by choice.

Muslim law applies to a person who professes Islam, whether he was born a Muslim or converted to Islam. In Narantakath Avullah v. Parakkal Mammu (Madras, 1922), the court held that a person who accepts the unity of God and the prophethood of Muhammad is a Muslim. Section 2 of the Shariat Application Act, 1937 then applies "where the parties are Muslims".

Why the other options are wrong.

  1. (a) excludes converts, who are equally Muslims.
  2. (b) excludes those born Muslim.
  3. (d) wrongly says converts are not covered.
