The Paper as Set

The questions in this volume are the questions asked at the Jun 2019 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

1. Answer the following in not more than two sentences, all 10 20 Marks

munotes.in 1

1.Who is the founder of Hanafi school of thought?[2]

Answer

The founder of the Hanafi school of Muslim law is Imam Abu Hanifa. The school is named after him.

Its place among the schools. The Hanafi school is the first and the most widely followed of the four Sunni schools. The others are the Maliki, Shafii and Hanbali schools.

Its leading pupils. The founder's leading disciples, among them Abu Yusuf, developed the school further. The classical texts record where their opinions differed from his on particular questions.

Its features.

  1. It gives the widest scope to reasoning, including analogy (qiyas) and juristic preference (istihsan).
  2. It allows a sane adult woman to contract her own marriage without a guardian.
  3. It recognises the irregular (fasid) marriage, alongside valid and void marriages.
  4. Its classical law gave effect to a talaq pronounced under compulsion or in intoxication.

Its texts. The Hedaya is one of the best-known Hanafi texts in India. The Fatawa Alamgiri is a major Hanafi compilation made in India.

Its importance in India. The great majority of Indian Muslims follow the Hanafi school. An Indian court presumes a Muslim to be Sunni, and in practice Hanafi, unless another school is proved. So Hanafi rules are the default in most Indian cases.

Example. In Abdul Kadir v. Salima (1886), the Allahabad High Court decided a question of dower using Hanafi texts, including the Hedaya.
