The Paper as Set

The questions in this volume are the questions asked at the Jan 2018 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Q.1 Write answers in One or Two sentences, all 10 20 Marks

munotes.in 1

1.State any two schools of Muslim Law.[2]

Answer

Two schools of Muslim law are the Hanafi school and the Shafii school. Both are Sunni schools.

1. The Hanafi school. It is named after Imam Abu Hanifa.

  1. It gives the most room to reasoning, including analogy and juristic preference (istihsan).
  2. It allows a sane adult woman to contract her own marriage.
  3. It recognises the irregular (fasid) marriage.
  4. It is followed by the great majority of Indian Muslims. An Indian court presumes a Muslim to be Sunni, and in practice Hanafi.

2. The Shafii school. It is named after Imam Shafii.

  1. It systematised the theory of the sources: the Quran, Sunna, Ijma and Qiyas in ranked order.
  2. It restricted juristic preference.
  3. It is stricter than the Hanafi school about the guardian's role in a woman's marriage.
  4. It is followed by some communities in the south and on the west coast of India.

The other schools.

munotes.in 2
  1. The other Sunni schools are the Maliki, after Imam Malik, and the Hanbali, after Imam Ahmad ibn Hanbal.
  2. The Shia schools are the Ithna Ashari, Ismaili and Zaidi.

Why schools matter. A school is not a source of law but a tradition of interpreting the sources. A party who proves that his family follows another school is governed by that school's rules.

So two schools are the Hanafi and the Shafii.
