How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Answer in not more than two sentences, all 10 20 Marks
Answer
A supplementary will is known in law as a codicil.
Where the term comes from. Section 2(b) of the Indian Succession Act, 1925 describes an instrument made "in relation to a will". It explains, alters or adds to the will, and the Act treats it as part of the will. Because it adds to a will already made, textbooks call it a supplementary will.
Codicil or a fresh will? A testator who wants a change has two choices.
| Codicil | Fresh will | |
|---|---|---|
| Relation to the old will | Builds on it | Usually replaces it |
| Size of change | Suited to small changes | Suited to large changes |
| Effect on the old will | Old will stands, as altered | Old will revoked if the new one says so |
| Formalities | Same as a will | Same as a will |
A codicil does not stand alone. It is read together with the will it supplements. A gift in the codicil and a gift in the will are construed as one scheme.
It can undo as well as add. By section 70, a codicil may revoke a will in whole or part. By section 73, a codicil showing that intention may revive a will already revoked.
No shortcut on formalities. A supplementary will is still a testamentary document. A civilian's codicil needs the testator's signature and two attesting witnesses, exactly as section 63 requires for a will.
Several codicils. A testator may make more than one. They are all read with the will, in order of date.
Example. Meera's will gives her flat to her son. Later she wants her niece to have her books. Instead of a new will, she signs a short codicil before two witnesses. The codicil is her supplementary will.
