The Paper as Set

The questions in this volume are the questions asked at the Apr 2014 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.State two grounds on which a Parsi woman can seek divorce.[2]

Answer

Under section 32 of the Parsi Marriage and Divorce Act, 1936, any married person, husband or wife, may sue for divorce on several grounds. Two of them are these.

1. Desertion: section 32(g). The defendant has deserted the plaintiff for at least two years. To "desert" means to leave the other spouse without reasonable cause and without consent, or against the other's will (section 2(3)).

2. Cruelty: section 32(dd). Since the marriage, the defendant has treated the plaintiff with cruelty. Or the defendant has behaved so that it would be improper to make the plaintiff live with him or her. The court may grant divorce or only judicial separation, in its discretion.

Other grounds she may use.

  1. Adultery, fornication, bigamy, rape or an unnatural offence since the marriage, sued for within two years of learning of it (section 32(d)).
  2. Grievous hurt, infection with venereal disease, or, where the defendant is the husband, compelling her to submit to prostitution (section 32(e)).
munotes.in 2
  1. A sentence of seven years or more for an offence, of which at least one year has been served (section 32(f)).
  2. Conversion: the defendant has ceased to be a Parsi (section 32(j)).

Two further statutory routes. Under section 32A, one year without resumption after judicial separation or restitution is a ground. Under section 32B, both may seek divorce by mutual consent after one year's separation.

So a Parsi woman could rely, for example, on two years' desertion or on cruelty.
