The Paper as Set

The questions in this volume are the questions asked at the Dec 2012 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.Define Codicil ?[2]

Answer

The definition: section 2(b). Under the Indian Succession Act, 1925, a codicil is an instrument made in relation to a will. It explains, alters or adds to the will's dispositions. It is deemed to form part of the will.

Its purpose. A codicil lets a testator make changes to his will without rewriting the whole of it. For example, he may add a gift, change a legatee, or appoint a new executor.

Its form. Because it is part of the will, it must be executed with the same formalities.

  1. An unprivileged codicil must be signed by the testator and attested by two witnesses (section 63).
  2. A privileged codicil follows section 66.

What it can do.

  1. Revoke a will, wholly or partly (section 70).
  2. Revive a revoked will, if it shows that intention (section 73).
  3. Confirm the will, or alter particular gifts.

Special rules.

munotes.in 2
  1. A legatee who attests a codicil confirming the will does not lose his legacy under the will (section 67, Explanation).
  2. A legacy in the will and another in a codicil are both taken, unless the will shows otherwise (section 101).

Probate. Probate covers the will together with its codicils.

Another name. A codicil is sometimes called a supplementary will.

Example. Grace's will leaves her house to her son. Later she signs, before two witnesses, a codicil leaving her jewellery to her niece. The will and codicil are read together.
