The Paper as Set

The questions in this volume are the questions asked at the Aug 2023 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.State any two objectives of the Environment Protection Act, 1986.[2]

Answer

The Environment (Protection) Act, 1986 states its objects in its long title and preamble. Section 3 shows how they are carried out. Any two, explained, will answer the question.

  1. Protection and improvement of the environment. The long title describes it as an Act to provide for the protection and improvement of environment. Section 3(1) gives the Central Government power to take all measures necessary for that purpose.
  2. Implementing the Stockholm decisions. The preamble recites the decisions of the United Nations Conference on the Human Environment, Stockholm, June 1972. Parliament considered it necessary to implement them.
  3. Preventing hazards. The preamble also aims at preventing hazards to human beings, other living creatures, plants and property.
  4. Co-ordination. Under section 3(2)(i), the Centre may co-ordinate the actions of State Governments and authorities under this Act and other related laws. This ends the earlier piecemeal approach.

  1. Standards. Under section 3(2)(iii) and (iv), it may lay down standards for environmental quality and for emissions and discharges.
  2. Hazardous substances and accidents. Under section 3(2)(vi) and (vii), it may lay down safeguards against accidents and for handling hazardous substances. This answered the gap exposed by Bhopal in 1984.
  3. Restricting industries by area. Under section 3(2)(v), it may restrict where industries operate.

Two to write. The two main objects are protecting and improving the environment, and preventing hazards to living beings and property. Both are drawn from the preamble.
