The Paper as Set

The questions in this volume are the questions asked at the Nov 2023 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.Who declares an area as a "National Park "under Wildlife (Protection) Act, 1972?[2]

Answer

Definition. "National Park" is defined in section 2(21) of the Wild Life (Protection) Act, 1972. It means an area declared as a National Park under section 35 or section 38. It also includes an area deemed to be declared one under section 66(3).

Who declares it.

  1. The State Government, section 35. It may declare an area a National Park, whether or not the area is within a sanctuary.
  2. The Central Government, section 38(2). It may do so for an area the State has leased or transferred to it.

The test: section 35(1). The area must be needed as a National Park because of its ecological, faunal, floral, geomorphological or zoological association or importance. The purpose is to protect, propagate or develop wildlife or its environment.

Procedure.

  1. Notice of intention under section 35(1), defining the limits of the area.

  3. No destruction or removal of wildlife or forest produce, except under a permit, under section 35(6).
