The Paper as Set

The questions in this volume are the questions asked at the Oct 2022 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.Noise pollution is a violation of Article 21 of the Indian Constitution was held in .

  • (a) Oleum Gas Leak Case
  • (b) L.K.Koolwal vs.State of Rajasthan
  • (c) P.A.Jacob vs. Suptd. Of Police
  • (d) None of the above

Answer

The answer is (c), P.A. Jacob v. Superintendent of Police.

In P.A. Jacob v. Superintendent of Police, Kottayam, AIR 1993 Ker 1, decided on 27 July 1992, the Kerala High Court considered the use of loudspeakers. It held that forcing unwilling persons to hear amplified sound at unpleasant levels infringes their right to a peaceful, pollution-free life under Article 21. The right to free speech under Article 19(1)(a) does not include a right to use loudspeakers in that way. The Supreme Court approved this reasoning in its noise pollution judgment of 2005.

Why the other options are wrong.

  1. (a) The Oleum Gas Leak case, AIR 1987 SC 1086, laid down absolute liability for hazardous industries.

  1. (b) L.K. Koolwal v. State of Rajasthan, AIR 1988 Raj 2, concerned sanitation in Jaipur and the citizen's right under Article 51A(g).
  2. (d) None of the above is wrong, because (c) is correct.
