The Paper as Set

The questions in this volume are the questions asked at the Dec 2012 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Answer the following, not more than two sentences

all 10 · 20 Marks

munotes.in 1

1.What is the basic composition of the National Environment Tribunal?[2]

Answer

The Act. The National Environment Tribunal Act, 1995 (Act 27 of 1995) provided for a Tribunal to award compensation for accidents in handling hazardous substances. It was repealed by section 38(1) of the National Green Tribunal Act, 2010.

Composition: section 9(1). The Tribunal was to consist of the following.

  1. A Chairperson.
  2. Such number of Vice-Chairpersons as the Central Government thinks fit.
  3. Such number of Judicial Members.
  4. Such number of Technical Members.

Benches: section 9(2). A Bench was to consist of one Judicial Member and one Technical Member. The principal Bench was to sit at New Delhi, with other Benches where the Central Government notified.

Qualifications: section 10.

munotes.in 2
  1. Chairperson. A sitting or former Judge of the Supreme Court or a High Court, or a Vice-Chairperson of two years' standing.
  2. Judicial Member. A person who is, or has been, or is qualified to be, a High Court Judge, among other routes.
  3. Technical Member. A person with adequate knowledge or experience of the administrative, scientific or technical aspects of environmental problems.

Appointment. By the President. The Chief Justice of India was to be consulted for the Chairperson and Vice-Chairpersons. A Selection Committee was to recommend the members.

The idea behind it. Pairing a judge with a technical expert brings law and science together. The same model was later adopted for the National Green Tribunal, which has Judicial and Expert Members.

In short. Chairperson, Vice-Chairpersons, Judicial and Technical Members, sitting in two-member Benches.
