The Paper as Set

The questions in this volume are the questions asked at the May 2017 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.What were the major changes introduced by the Regulating Act of 1773?[2]

Answer

The Regulating Act, 1773 was the first Act by which the British Parliament controlled the East India Company's rule in India. The Company had become nearly bankrupt after the Bengal famine of 1770, and its servants were growing rich through presents and private trade. Parliament stepped in.

The major changes were five.

  1. A Governor-General of Bengal with a Council of four. Decisions were taken by majority, and the Governor-General had only a casting vote. Warren Hastings was the first Governor-General.
  2. Madras and Bombay were placed under Bengal in matters of war and peace.
  3. A Supreme Court of Judicature at Fort William (Calcutta) was provided for by section 13. It was set up by the Charter of 26 March 1774, with a Chief Justice and three judges. Sir Elijah Impey was the first Chief Justice.

  1. Company servants were forbidden to take presents or bribes and to carry on private trade.
  2. The Company had to send its correspondence on revenue, civil and military affairs to the British Government, so that Parliament could supervise it.

Why it matters. It was the first step towards parliamentary control over the government of India. Its great defect was that it set up a court without defining its jurisdiction. This led to open conflict between the Supreme Court and the Governor-General's Council. The Act of Settlement of 1781 settled that conflict.
