The Paper as Set

The questions in this volume are the questions asked at the Oct 2025 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  20 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q1.

Answer the following in one or two sentence, any 6 of 8 12 Marks

munotes.in 1

(1)Define "wrongful restraint" under the BNS 2023?[2]

Answer

Wrongful restraint means voluntarily obstructing a person so as to prevent him from going in a direction in which he has a right to go. It is defined in section 126(1) of the Bharatiya Nyaya Sanhita, 2023. This was section 339 of the Indian Penal Code.

The definition. Section 126(1) says: "Whoever voluntarily obstructs any person so as to prevent that person from proceeding in any direction in which that person has a right to proceed, is said wrongfully to restrain that person."

Its three elements.

  1. The accused voluntarily obstructs another person.
  2. The obstruction prevents that person from proceeding in some direction.
  3. The person has a right to proceed in that direction.
munotes.in 2

Partial restraint is enough. The person need not be stopped from moving in every direction. Blocking one road he has a right to use is enough. That is how wrongful restraint differs from wrongful confinement under section 127. Confinement prevents a person from going beyond certain limits in every direction, as when he is locked in a room.

The Exception. Obstructing a private way over land or water is not wrongful restraint in one case. That is where the person believes in good faith that he has a lawful right to obstruct it.

The illustration. A obstructs a path along which Z has a right to pass. A does not believe in good faith that he has a right to stop the path. Z is prevented from passing. A wrongfully restrains Z.

Punishment, section 126(2). Simple imprisonment up to one month, or fine up to five thousand rupees, or both. The Penal Code's fine under section 341 was only five hundred rupees.

Example. A landlord stands at the gate and refuses to let a tenant leave for work until he pays the rent. The tenant has a right to go out, so the landlord commits wrongful restraint.
