The Paper as Set

The questions in this volume are the questions asked at the May 2025 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(1)What is undue influence at elections?[2]

Answer

Undue influence at an election means voluntarily interfering, or attempting to interfere, with the free exercise of any electoral right. It is defined in section 171 of the Bharatiya Nyaya Sanhita, 2023, which was section 171C of the Indian Penal Code. It sits in Chapter IX, the offences relating to elections.

What an "electoral right" is. Section 169(b) defines it. It is the right of a person to stand, or not to stand, as a candidate, or to withdraw from being a candidate. It is also the right to vote, or to refrain from voting, at an election.

Two forms the law treats as interference, section 171(2). These apply without limiting the general definition.

  1. A person threatens a candidate or a voter with injury of any kind. The threat may also be aimed at any person in whom the candidate or voter is interested.
  2. A person makes a candidate or voter believe that he will become an object of Divine displeasure or of spiritual censure. It is the same if the threat is aimed at someone he cares about.

What is not undue influence, section 171(3). A declaration of public policy is not interference. Nor is a promise of public action. Nor is the mere exercise of a legal right without intent to interfere with an electoral right.

Example. A village leader warns families that anyone who votes for a rival candidate will be thrown out of the village. That is a threat of injury, so it is undue influence. A party that promises free bus travel in its manifesto is only declaring public policy.

Punishment, section 174. Imprisonment of either description for a term up to one year, or fine, or both. The same section punishes personation at an election.

The offence protects the voter's free choice. Fear, threats and religious pressure are punished, while open campaigning on policy remains lawful.
