munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the Nov 2022 - 60/40 examination.

The law in these answers is stated as at October 2026. The Income-tax Act, 2025 replaced the Act of 1961 from 1 April 2026; each answer gives the 1961 section the paper asks for, with the 2025 section beside it. No wealth-tax is charged for the assessment year 2016-17 or any later year (section 3(2) of the Wealth-tax Act, as amended in 2015). Since 1 July 2017 the Maharashtra VAT Act covers only liquor and a few petroleum products, and the Central Sales Tax Act six goods; other goods are taxed under the GST Acts of 2017. The central sales tax rate on sales against Form C has been 2 per cent since 1 June 2008, though section 8(1) still prints 3 per cent. The standard deduction from salary, withdrawn from 2005-06 to 2018-19, is now Rs 50,000, or Rs 75,000 under the new regime.

The Paper as Set

The questions in this volume are the questions asked at the Nov 2022 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

Instructions printed on the paper

  • N.B: Please check whether you have got the right question paper. 1. Please read the Instructions carefully. 2. Do not disclose your identity or mark any inscriptions, signages etc. anywhere on the answer sheets.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What do you understand by 'Multipoint Tax'?[2]

Answer

A multipoint tax (also called a multi-stage tax) is a tax charged at every stage at which goods or services change hands. The chain runs from the manufacturer to the wholesaler, the retailer and finally the consumer. Each sale in that chain is taxed.

It is the opposite of a single-point tax, which is charged only once in the chain. A sales tax charged only on the first sale of goods inside a State is a single-point tax. Later sales of the same goods in that State then carry no tax.

Two kinds of multipoint tax.

  1. Without credit. Each seller pays tax on his full selling price. That price already includes the tax paid at the earlier stage. So tax is charged on tax. This is called cascading, and it makes goods dearer the longer the chain.
  2. With credit. Each registered buyer takes credit for the tax charged to him on his purchases. He pays only the balance on his sale. So, in effect, each stage pays tax only on the value it adds. This is the value added tax method.

Examples in Indian law.

  • The Maharashtra Value Added Tax Act, 2002 taxed sales at each stage. It gave the buying dealer a set-off of the tax paid on his purchases (section 48).
  • GST is a multipoint tax with credit. Central tax and State tax are levied on every taxable supply (section 9(1) of the CGST Act, 2017). Each registered buyer takes input tax credit of the tax charged to him (section 16(1)).

Illustration. A manufacturer sells goods for Rs 1,000 and charges 10 per cent tax, Rs 100. A retailer sells them for Rs 1,200 and charges Rs 120. He takes credit of Rs 100 and pays only Rs 20. The total tax, Rs 120, is 10 per cent of the final price.
