The Paper as Set

The questions in this volume are the questions asked at the Oct 2026 - ATKT 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

Instructions printed on the paper

  • N.B: 1. All Questions are Compulsory. 2. Figures to the right indicate full marks. 3. Give case-law/reasons wherever necessary.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

(a)Who is the indemnity-holder and the indemnifier? Explain with a suitable illustration.[2]

Answer

In "a contract by which one party promises to save the other from loss caused to him by the conduct of the promisor himself, or by the conduct of any other person" (section 124 of the Indian Contract Act, 1872), the party who promises is the indemnifier. The party protected is the indemnity holder.

Example. A contracts to indemnify B against the consequences of proceedings which C may take against B for Rs 200 (the illustration to section 124). A is the indemnifier and B the indemnity holder.

The holder's rights. Acting within his authority, he may recover the damages he is made to pay, and his costs if he acted prudently. He may also recover sums paid under a prudent compromise (section 125).

Gajanan Moreshwar Parelkar v. Moreshwar Madan Mantri, AIR 1942 Bom 302. At the defendant's request, the plaintiff mortgaged land in his name for the defendant's debts, and the defendant promised to clear them. The plaintiff sued before paying anything himself. The Bombay High Court held that sections 124 and 125 are not exhaustive. Once the indemnity holder's liability is absolute, he may make the indemnifier pay it off.

So the indemnifier promises to bear the loss, and the indemnity holder is the one he protects.
