How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.Enumerate the four stages of crime commission.[2]

Answer

A crime passes through four stages before it is complete.

  1. Intention. The formation of the guilty mind. This is never punishable by itself. The law cannot look into a man's mind, and a person may still abandon the plan.
  2. Preparation. Arranging the means, such as buying poison or loading a gun. As a rule this is not punishable, because it is equivocal. A man who buys poison may mean to kill rats.
  3. Attempt. Taking a step towards the offence after preparation is complete. This is punishable.
  4. Commission. The completed offence, charged as the substantive crime.

Preparation is punishable in a few grave cases. Section 122 punishes collecting arms to wage war against the Government of India, now section 149 of the Bharatiya Nyaya Sanhita, 2023. Section 399 punishes making preparation to commit dacoity, now section 310(4).

Attempt is punished in two ways. Some attempts have their own section, such as section 307 for attempt to murder. Every other attempt falls under the general section 511, now section 62 of the Sanhita. It allows up to one half of the longest term provided for that offence.

An attempt is punishable even where it could not have succeeded. Section 511 gives the example of a man who picks a pocket that turns out to be empty.
