The Paper as Set

The questions in this volume are the questions asked at the Jun 2018 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.Define Voluntarily as per IPC.[2]

Answer

Section 39 of the Indian Penal Code, 1860 is now section 2(33) of the Bharatiya Nyaya Sanhita, 2023. A person causes an effect "voluntarily" in two cases.

  1. He causes it by means by which he intended to cause it.
  2. He causes it by means which, when he used them, he knew or had reason to believe to be likely to cause it.

The key point. "Voluntarily" is wider than "intentionally". It covers effects a person knew were likely, even if he did not want them.

Illustration. A sets fire by night to an inhabited house in a large town, to make a robbery easier. A person dies. A may not have intended death, and may even be sorry for it. But if he knew death was likely, he caused death voluntarily.

Where the word is used.

  1. Voluntarily causing hurt (section 115) and grievous hurt (section 117).
munotes.in 2
  1. Wrongful restraint, which is voluntarily obstructing a person (section 126).
  2. Undue influence at elections, which is voluntarily interfering with an electoral right (section 171).

Knowledge and reason to believe. "Reason to believe" means sufficient cause to believe a thing (section 2(29)). So a person cannot escape by saying he did not think about the result, if a reasonable person would have foreseen it.

Example. A throws a heavy stone into a crowd. He does not aim at anyone, but he knows someone is likely to be hurt. B is hit and injured. A voluntarily causes hurt to B.
