The Paper as Set

The questions in this volume are the questions asked at the Jun 2026 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.What do you mean by Qiyas?[2]

Answer

Qiyas means analogical deduction. It is the fourth of the classical sources of Muslim law. A rule laid down for one case is extended to a new case that shares the same effective cause.

Its four elements.

  1. Asl, the original case, settled by the Quran, Sunna or ijma.
  2. Hukm, the rule laid down for that case.
  3. Illat, the effective cause or reason for the rule.
  4. Far, the new case, to which the rule is extended.

The conditions.

  1. The original rule must come from the Quran, Sunna or ijma, not from another analogy.
  2. The illat must be identifiable.
  3. The result must not contradict a clear text.
  4. There must be a gap to fill.

Its rank. Qiyas ranks fourth and weakest among the primary sources, after the Quran, the Sunna and ijma. A rule reached by analogy gives way to a clear text.

The Shia position. The Shia schools do not accept qiyas in the Sunni sense. Their fourth source is aql, reason.

Why it matters. Muslim jurists faced many new questions on which the texts were silent. Qiyas let them apply the reason behind an existing rule to those questions. Disagreement about the illat is one main reason the schools differ.

Example. The Quran prohibits wine. The effective cause is intoxication. By qiyas, the jurists extended the prohibition to other intoxicants that share that cause.
