The Paper as Set

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: 1. All questions are compulsory. 2. Figures to the right indicate full marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Q.1 Answer in one or two sentences, all 10 20 Marks

munotes.in 1

1.What is Fatwa-i- Alamgiri?[2]

Answer

The Fatawa-e-Alamgiri (Fatawa Alamgiri) is a major compilation of Hanafi law, made in India. It records the rulings of the Hanafi jurists on the questions of Muslim law.

Its nature. It is a book about the law, not a source of law. Like the Hedaya, it is an authority: a citable statement of what the classical law provides. The sources themselves remain the Quran, the Sunna, ijma and qiyas.

Its use in Indian courts. Indian judges have relied on it for centuries to find the Hanafi rule.

  1. In Abdul Kadir v. Salima (1886), Mahmood J. translated its statement of the legal effects of marriage. Marriage legalises relations between the spouses, and makes dower, maintenance and clothing obligatory on the husband.
  2. In Imambandi v. Sheikh Haji Mutsaddi (1918), the Privy Council cited its treatment of dependent sales and of sales by guardians.
  3. It is quoted for the rule against marrying two sisters at the same time.
munotes.in 2

A caution. It is a seventeenth-century statement of the classical law. Some parts do not represent the law a court would apply today. An answer should say so rather than quote it as current law.

Its importance. Most Indian Muslims follow the Hanafi school, and an Indian court presumes a Muslim to be Hanafi. So the Fatawa Alamgiri remains one of the main texts a court consults on Hanafi rules.

Other leading texts. The Hedaya, and as a modern statement, Mulla's Principles of Mahomedan Law.
