The Paper as Set

The questions in this volume are the questions asked at the 2021-22 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.The ______ institution(s) is/are excluded from the scope of Shariat Act, 1937. (a) Charitable&Religious (b) Marriage & Divorce (c) Maintenance &Dower (d) Guardianship &Adoption

Answer

The answer is (a), charitable and religious institutions.

Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937 makes Muslim personal law the rule of decision in listed matters. It includes wakfs, but expressly leaves out "charities and charitable institutions and charitable and religious endowments". It also excludes questions about agricultural land.

Why the other options are wrong.

  1. (b) Marriage and divorce are expressly covered, including talaq, ila, zihar, lian, khula and mubaraat.
  2. (c) Maintenance and dower are expressly covered.
  3. (d) Guardianship is covered. Adoption is not in section 2, but a Muslim may bring it in by a declaration under section 3. So the pair is not "excluded".
