The Paper as Set

The questions in this volume are the questions asked at the Jun 2026 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.What is the difference between the Constitution and Constitutionalism?[2]

Answer

A Constitution is the document, or body of rules, that sets up the organs of the State. It gives them their powers and states the rights of the people. Constitutionalism is the idea that this power must be limited, so that government acts only within the law and cannot become arbitrary.

The difference in short.

  1. A Constitution is a legal text. Constitutionalism is a principle about how power should be used.
  2. A country may have a Constitution without constitutionalism, if its rulers ignore the limits it sets. A dictatorship can have a written Constitution and still rule by decree.
  3. Constitutionalism is measured by real limits on power. These include the separation of powers, judicial review, fundamental rights and free elections.

In India. The Constitution of India puts constitutionalism into practice. Fundamental rights restrain the State, the courts review laws and executive action, and Parliament cannot destroy the basic structure. In Kesavananda Bharati v. State of Kerala (1973) 4 SCC 225, the Supreme Court held that even the power to amend the Constitution is limited. That holding is constitutionalism at work.

Why it matters. A written Constitution is only as good as the respect shown to its limits. Constitutionalism is the habit of obeying them. It ensures that those who govern are themselves governed by law.

Conclusion. The Constitution is the framework of government. Constitutionalism is the commitment that the framework will restrain the people who hold power.
