The Paper as Set

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.Which Act proclaimed lapse of British paramountacy over Indian States?[2]

Answer

The Indian Independence Act, 1947 proclaimed the lapse of British paramountcy over the Indian States. It did so by section 7(1)(b).

What paramountcy meant. About 560 princely States were not part of British India. Their rulers had accepted the suzerainty, or overlordship, of the British Crown through treaties. The Crown controlled their defence and foreign affairs. This supremacy was called paramountcy.

What section 7 did. From 15 August 1947:

  1. The suzerainty of the Crown over the Indian States lapsed.
  2. All treaties and agreements between the Crown and the rulers came to an end.
  3. The Crown's functions towards the tribal areas also ended.

The effect. In law, the States became free to join India, join Pakistan or remain independent. Paramountcy did not pass to the new Dominions. So the States were integrated by Instruments of Accession and later merger agreements, through the work of Sardar Vallabhbhai Patel and V.P. Menon. Nearly all of them had acceded before 15 August 1947. Hyderabad, Junagadh and Jammu and Kashmir were the main exceptions, and were integrated later.

Its place in our Constitution. The Act of 1947 was itself repealed by article 395 of the Constitution. Paramountcy has no place in the Republic: the former rulers' privy purses were finally abolished by the Twenty-sixth Amendment in 1971.
