The Paper as Set

The questions in this volume are the questions asked at the 2025-26 - ATKT Set 2 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

Instructions printed on the paper

  • N.B: 1. All Questions are compulsory. 2. Figures to the right indicate full marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

Q.1. Answer in two sentences only

any 6 of 10 · 12 Marks

munotes.in 1

(a)"Now it is clear law that copyright cannot exist in a work of a tendency so grossly immoral as this." Who is the speaker of the above statement? Identify the case.[2]

Answer

The answer, in the two sentences the paper allows. The speaker is Justice Younger, the English Chancery judge who decided the case. The case is Glyn v. Weston Feature Film Co., [1916] 1 Ch 261, in which the novelist Elinor Glyn sued over a film that parodied her novel Three Weeks.

Where the line comes from. Elinor Glyn's novel Three Weeks (1907) told of a young Englishman's love affair with a married queen. A film company made a comic burlesque of it, "Pimple's Three Weeks (without the option)", and Glyn sued for infringement of her copyright.

Why the line matters. Younger J. refused her any relief. He held that the film did not infringe her copyright. He added that a court of equity would give no protection to a book of so immoral a tendency. The case is still cited for the old rule that the law will not protect a grossly immoral work.
