1.What is the significance of the 106th Amendment Act 2023 in terms of political empowerment of women?[2]
Answer
The 106th Constitutional Amendment Act, 2023, called the Nari Shakti Vandan Adhiniyam, provides for the reservation of one-third of the seats for women in the Lok Sabha, in the State Legislative Assemblies and in the Legislative Assembly of the National Capital Territory of Delhi. Within that share, one-third of the seats reserved for Scheduled Castes and Scheduled Tribes are also reserved for women of those communities. The reservation is to operate for fifteen years, extendable by Parliament, and reserved seats are to be rotated after each delimitation.
Its significance:
- It extends to the national and State legislatures the reservation that has existed at the local level since the 73rd and 74th Amendments, 1992, and so completes the design at all three tiers.
- It addresses the very low share of women in Parliament, which has never reached fifteen per cent of the Lok Sabha.
- It brings into law-making the perspectives of half the population, on questions of safety, health, education and property where representation demonstrably changes outcomes.
It is not yet in force. The Act provides that the reservation shall take effect only after the first census conducted after its commencement, and after the delimitation exercise undertaken on the basis of that census.
