The Paper as Set

The questions in this volume are the questions asked at the 2024-25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is the definition of sovereignty as given by Jean Bodin? What is the restriction imposed on the sovereign by Bodin?[2]

Answer

Bodin's definition. Jean Bodin, the French jurist, gave the first systematic definition of sovereignty in his Six Books of the Commonwealth (1576): "Majestie or Soveraigntie is the most high, absolute, and perpetuall power over the citisens and subjects in a Commonweale". His Latin definition is usually translated as "Sovereignty is supreme power over citizens and subjects, unrestrained by the laws." Its main mark is the power "to give lawes unto all and every one of the subjects, and to receive none from them".

The restrictions he imposed on the sovereign. Bodin's sovereign is free from the civil laws he makes, but not from everything.

  1. The laws of God, of nature and of nations. "All princes of the earth are subject unto the lawes of God, of nature, and of nations."
munotes.in 2
  1. The fundamental laws of the realm. The prince "cannot derogat from" the laws "which concerne the state of the realme", "such as is the law Salique", which fixed the succession to the French crown.
  2. His own contracts and his subjects' property. He must keep his agreements, and "Without just cause the sovereign cannot seize or grant away the property of another" (as Dunning reports Bodin).

These limits are moral and constitutional, not enforced by any court. Only God enforces the law of nature against a sovereign.
