The Paper as Set

The questions in this volume are the questions asked at the 2026-27 - ATKT 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

Instructions printed on the paper

  • N.B. 1) All questions are compulsory 2) All figures to the right indicate marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)Define public interest litigation[2]

Answer

In public interest litigation (PIL), a person or organisation acting in good faith asks a court to enforce the rights of others. Those others cannot come to court themselves. It may also ask the court to stop a public wrong that injures the public generally. It is filed as a writ petition under Article 32 in the Supreme Court or Article 226 in a High Court.

How it became possible. The old rule of locus standi allowed only a person whose own legal right was injured to ask for a writ. In S.P. Gupta v. President of India, AIR 1982 SC 149, the Supreme Court relaxed it in two ways:

  1. For those who cannot come to court. Where poverty, helplessness or disability keeps a person or a class from approaching the court, "any member of the public" may seek relief for them.
  2. For the public at large. Any member of the public "having sufficient interest" may seek redress for a public injury caused by a breach of public duty or of the law.

The condition. The petitioner must act bona fide, not for personal gain, private profit or a political motive. Even a letter to the court may be treated as a petition.

Example. In Municipal Council, Ratlam v. Vardhichand, AIR 1980 SC 1622, residents made a municipality build drains and stop a public nuisance.
