(1)What is the object behind sec 125 of the criminal procedure code?
Answer
Section 125 of the Code of Criminal Procedure, 1973 is now Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Its object is to give a speedy, summary and inexpensive remedy against destitution and vagrancy. It makes a person of sufficient means maintain his wife, his legitimate or illegitimate minor children, and his father or mother, if they cannot maintain themselves.
It is a measure of social justice, backed by Articles 15(3) and 39 of the Constitution. It is also secular in operation: it applies to persons of every religion, whatever their personal law, as Mohd. Ahmed Khan v. Shah Bano Begum, AIR 1985 SC 945, held for a divorced Muslim wife.
