The Paper as Set

The questions in this volume are the questions asked at the Apr 2025 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is Amniocentesis?[2]

Answer

Amniocentesis is a pre-natal test in which a doctor draws a little of the fluid around the foetus with a thin needle. The sample, taken under ultrasound guidance, is tested for genetic disorders, birth defects or infection. It is usually done between the 15th and 20th weeks of pregnancy. The test can also reveal the sex of the foetus, which is why the law controls it.

In law. "Taking or removing samples of amniotic fluid" is a "pre-natal diagnostic procedure" (section 2(i), Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994). So:

  1. It may be done only to detect the abnormalities listed in section 4(2), such as chromosomal abnormalities and congenital anomalies.
  2. One of the conditions in section 4(3) must be met and recorded. Examples are that the woman is above thirty-five, or has had two or more spontaneous abortions.
  3. Her written consent is taken in Form G, in a language she understands (section 5(1); rule 10).
  4. The sex of the foetus may not be communicated "by words, signs, or in any other manner" (section 5(2)).

Records. In Federation of Obstetrics and Gynecological Societies of India (FOGSI) v. Union of India, (2019) 6 SCC 283, the Supreme Court held the complete contents of Form F, which records invasive tests such as amniocentesis, to be mandatory.
