In one line

The WTO exists to run a set of trade agreements, to host the negotiation of new ones, to settle the disputes they generate and to review what its members actually do, and its stated objective is not free trade but rising living standards.

In exam wording: the objectives of the WTO are those recited in the Preamble to the Marrakesh Agreement, its scope is fixed by Article II as the common institutional framework for trade relations in matters covered by the Annexes, and its functions are the five listed in Article III.

The Preamble, and the two things it added to GATT

It restates GATT's objects, raising standards of living, ensuring full employment and a large and steadily growing volume of real income and effective demand, and expanding the production of and trade in goods and services, the last three words being new.

It adds sustainable development. The parties recognise that their trade and economic endeavour should allow for the optimal use of the world's resources in accordance with the objective of sustainable development, seeking both to protect and preserve the environment and to enhance the means for doing so in a manner consistent with their respective needs and concerns at different levels of economic development. GATT's preamble spoke of developing the full use of the resources of the world; this speaks of optimal use and sustainability, and the change was not accidental.

It adds a positive development undertaking. There is need for positive efforts designed to ensure that developing countries, and especially the least developed among them, secure a share in the growth of international trade commensurate with the needs of their economic development.

The sustainable development language has done real legal work. In United States: Import Prohibition of Certain Shrimp and Shrimp Products, WT/DS58/AB/R, adopted 6 November 1998, the Appellate Body used the Preamble's reference to sustainable development to read the words exhaustible natural resources in Article XX(g) as including living species. Facts. Section 609 of United States Public Law 101-162 banned imports of shrimp harvested with technology that might adversely affect sea turtles unless the harvesting nation was certified, and India, Malaysia, Pakistan and Thailand complained. Held. living species are exhaustible natural resources and a measure conditioning access on another country's conservation policy is not for that reason outside Article XX, but the American scheme failed the chapeau for arbitrary and unjustifiable discrimination. India and its co-complainants won on the chapeau. Why it matters here: a preamble is not decoration, it is context for interpretation under the customary rules the DSU adopts.

Scope: what the organisation is about

Article II:1 defines the WTO's field by reference to its own annexes, and that is an unusual drafting choice worth noticing. The organisation has no subject matter of its own: it covers what the members have put in the annexes and nothing else.

Three consequences follow, and the third is the one candidates miss. The organisation cannot acquire jurisdiction by practice; new subjects arrive only by negotiation and amendment. A dispute may be brought only under a covered agreement. And the map of WTO case law is therefore also a map of the organisation's scope: there is no dispute about competition policy, none about investment protection and none about labour standards, because there is no covered agreement on any of them.

Functions: the five, with what each means in practice

One, administering the agreements. In practice this is the work of the councils and committees: notifications, reviews, questions and answers between members about each other's measures, and the maintenance of the schedules.

Two, the forum for negotiations. The Ministerial Conference sets mandates and rounds proceed under them. This is the function that has failed since 2001, and the honest answer says so.

Three, administering the DSU. The organisation supplies the Dispute Settlement Body, the Secretariat's legal support, the roster of panellists and the standing appellate tier, which since December 2019 it has not been able to supply.

Four, administering the TPRM. Periodic review of every member's whole trade regime, on two reports, one by the government and one independently by the Secretariat.

Five, cooperation with the Fund and the Bank for coherence.

A worked illustration of the functions operating together

Suppose member A adopts a new certification requirement for imported machinery.

Function one brings it to the TBT Committee as a notification and as a specific trade concern raised by exporters. Function four will bring it up again in A's next trade policy review, where other members ask about it on the record. If A and its trading partners cannot resolve it, function three is available: a member may request consultations and then a panel under the DSU, and the panel will apply the TBT Agreement, which A accepted under the single undertaking. And if the members conclude that the rules on conformity assessment need changing, function two is the only route to changing them.

That is the whole institution in one example, and it is a good structure for the essay: administration first, review second, adjudication third, negotiation last, because negotiation is the only one that can change the rules.

The criticism that belongs in this answer

The functions are unequally alive. Dispute settlement and trade policy review have worked continuously; the negotiating function has produced only the Trade Facilitation Agreement in 2017 and the Agreement on Fisheries Subsidies in 2025 in a quarter of a century; and since December 2019 the appellate tier of the third function has had no members. A candidate who lists five functions without saying which of them currently work has described the design and not the organisation.

What this does NOT mean

It does not mean the WTO's objective is free trade. Trade liberalisation is the means the Preamble adopts; the ends are living standards, employment, real income and sustainable development. This distinction is worth a sentence in almost any essay on this paper.

It does not mean the WTO can act on a subject because it is important. Labour standards, competition and investment protection are important and are outside the annexes, so they are outside the organisation.

And it does not mean the members are the organisation's subjects. The organs of the WTO are composed of the members themselves; the Secretariat takes no decisions at all.

2. Explain the scope of the WTO and the consequence of the way Article II defines it. Article II:1 provides that the WTO shall provide the common institutional framework for the conduct of trade relations among its members in matters related to the agreements and associated legal instruments included in the Annexes to the Agreement. The organisation therefore has no subject matter of its own: its jurisdiction is entirely derivative from what the members have annexed, and Article II:2 makes the Annex 1, 2 and 3 agreements integral parts binding on all members while Article II:3 leaves the Annex 4 plurilaterals binding only on their parties. Three consequences follow. Jurisdiction cannot be acquired by practice or by the importance of a subject; it arrives only by negotiation and amendment. A dispute may be brought only under a covered agreement, so the DSU's reach is the annexes' reach. And the body of WTO case law is therefore a map of the organisation's limits as much as of its rules: there is no jurisprudence on competition policy, investment protection or labour standards, because there is no covered agreement on any of them.

3. Are the five functions of the WTO equally effective? Discuss. No, and the differences are the substance of any serious answer. The administrative function under Article III:1 operates continuously through the councils and committees, which receive notifications, put questions and record specific trade concerns, and it is the least visible and most constant work the organisation does. The trade policy review function under Article III:4 has never been interrupted, examines every member on the basis of a government report and an independent Secretariat report, and creates transparency without creating any obligation. Dispute settlement under Article III:3 was the great achievement of 1995 and remains partly effective, but the Appellate Body lost its quorum on 11 December 2019 and its last member's term expired on 30 November 2020, so an appeal now goes into a void and the report is never adopted. The negotiating function under Article III:2 has effectively failed: the Doha round launched in 2001 has never been concluded, and only two multilateral agreements have been added in thirty years, on trade facilitation in 2017 and fisheries subsidies in 2025. The coherence function under Article III:5 is an obligation to cooperate with the Fund and the Bank, pursued through consultation and joint capacity building, with no machinery to compel a common line.
