The Paper as Set

The questions in this volume are the questions asked at the May 2016 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: (1) All questions are compulsory. (2) Figures to the right indicate marks. (3) Give reasons / case-law wherever necessary.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

Q.1: Answer the following in not more than two sentences

20 Marks - 2 marks each

munotes.in 1

(a)Define a Bill of exchange.[2]

Answer

Definition. Section 5 of the Negotiable Instruments Act, 1881 defines it: "A 'bill of exchange' is an instrument in writing containing an unconditional order, signed by the maker, directing a certain person to pay a certain sum of money only to, or to the order of, a certain person or to the bearer of the instrument".

The three parties.

  1. The drawer makes the bill and gives the order.
  2. The drawee is ordered to pay. Once he signs his assent, he is the acceptor.
  3. The payee is the person to whom the money is to be paid.

Its essentials. The bill must be in writing. It must contain an order, not a request, and the order must be unconditional. It must be signed by the drawer. The drawee and the payee must be certain persons, and the sum must be a certain sum of money only.

An example. "Three months after date pay to C or order Rs 10,000, for value received. To B. Signed, A." Here A is the drawer, B the drawee and C the payee.

Not conditional by time. An order is not conditional merely because payment falls due on an event certain to happen, such as a person's death (explanation to section 5).

Conclusion. A bill of exchange is a written, signed, unconditional order by the drawer to the drawee. It directs him to pay a certain sum of money to a certain person or to bearer.
