How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Q.1: Answer the following in not more than two sentences
20 Marks - 2 marks each
Answer
The definitions (section 7 of the Negotiable Instruments Act, 1881).
An example. Iyer, a spice trader of Kochi, writes: "Three months after date pay Malabar Bank or order Rs 50,000", addressed to Shah, his buyer in Ahmedabad, and signs it. Iyer is the drawer, Shah the drawee, and Malabar Bank the payee.
Related terms in the same section.
Their liabilities, in short. Until acceptance the drawer is liable as principal debtor, and after acceptance the acceptor is (section 37). The drawer must compensate the holder if the drawee or acceptor dishonours the bill, provided due notice of dishonour is given (section 30).
One person in two roles. The drawer may make the bill payable to his own order, so the drawer and payee may be the same person.
Conclusion. The drawer makes and signs the bill, and the drawee is the person directed to pay it (section 7). The payee is the person to whom, or to whose order, the money is to be paid.
