The Paper as Set

The questions in this volume are the questions asked at the Apr 2025 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

Instructions printed on the paper

  • Note: 1. Please check whether you have got the right question paper. 2. Answer all questions. 3. Total marks are indicated to the right.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)Define 'Advertisement' under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954.[2]

Answer

An "advertisement" under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 is any notice or announcement that publicises a drug or remedy. Its form and medium do not matter. The Act defines it very widely in section 2(a).

The definition. "'Advertisement' includes any notice, circular, label, wrapper or other document, and any announcement made orally or by any means of producing or transmitting light, sound or smoke" (section 2(a)).

What it covers.

  1. Printed matter: notices, circulars, pamphlets and newspaper insertions.
  2. The product itself: a label or wrapper on a medicine is an advertisement, so a claim printed on a carton is caught.
  3. Spoken and broadcast matter: an oral announcement, radio, television and, through "light, sound", online videos.

Who is liable. "Taking any part in the publication" of an advertisement includes printing it (section 2(d)). So the printer and publisher are caught, not only the maker. A person living in India who causes the advertisement to be published abroad also takes part in it (section 2(d)).

Upheld. In Hamdard Dawakhana (Wakf) Lal Kuan v. Union of India, AIR 1960 SC 554, the Supreme Court held that a commercial advertisement for one's own business is not protected free speech. It upheld this wide definition, including labels, as suited to the Act's object of preventing self-medication.
