The Paper as Set

The questions in this volume are the questions asked at the Oct 2024 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)Define Transplantation under Transplantation of Human Organs & Tissues Act, (THOTA) 1994.[2]

Answer

Transplantation is the grafting of a human organ from one person, living or dead, into another living person for treatment. The Act defines it in section 2(p) of the Transplantation of Human Organs and Tissues Act, 1994.

The definition. "'Transplantation' means the grafting of any human organ from any living person or deceased person to some other living person for therapeutic purposes" (section 2(p)).

Its parts.

  1. A human organ. "Any part of a human body consisting of a structured arrangement of tissues which, if wholly removed, cannot be replicated by the body" (section 2(h)), such as a kidney or a heart.
  2. From the living or the dead. The donor may be living or deceased, including a brain-stem dead person certified under section 3(6).
  3. For therapy only. "Therapeutic purposes" means "systematic treatment of any disease or the measures to improve health" (section 2(o)). Grafting for any other purpose, including sale, is forbidden (section 11).

How the law controls it. Transplantation may be done only in a registered hospital (section 10). A living donor who is not a near relative needs the Authorisation Committee's approval (section 9(3)). In Kuldeep Singh v. State of Tamil Nadu, (2005) 11 SCC 122, the Supreme Court said the Act was founded on "the shocking exploitation of abject poverty of many donors".
