(a)What is 'autopsy'?[2]
Answer
An autopsy, or post-mortem examination, is the examination of a dead body. It finds out who the person was, when the person died and what caused the death. "Post-mortem is otherwise known as Autopsy or Necropsy" (NDMA Guidelines, Management of the Dead in the Aftermath of Disasters, 2010).
Its object. It establishes "the identity of a body, when not known", the time since death and the cause of death. It also shows "whether the death was natural or unnatural and if unnatural, whether it was homicidal, suicidal or accidental" (NDMA, 2010).
Its two kinds.
- Clinical or academic autopsy. Doctors perform it "with the consent of the relatives", to learn the extent of the illness for which the patient was treated.
- Medico-legal autopsy. It is done at the request of the police or an Executive Magistrate in a sudden, suspicious, unnatural or criminal death. The police officer forwards the body to "the nearest Civil Surgeon, or other qualified medical person" where "there is any doubt regarding the cause of death" (section 194(3)(iv), Bharatiya Nagarik Suraksha Sanhita, 2023).
Why it matters in court. In State of Jharkhand v. Shailendra Kumar Rai, decided on 31 October 2022, the post-mortem report showed that a burnt woman died of septicaemia from her burns. So her statement about the burning was admissible as a dying declaration. In an earlier case the body was cremated without a post-mortem, and nothing proved the cause of death.
