The Paper as Set

The questions in this volume are the questions asked at the Apr 2014 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  24 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

(a)Define 'Hospital' according to the Transplantation of Human Organs Act, 1994[2]

Answer

Under the transplantation law, a hospital is any institution that treats patients, of whatever name. "'Hospital' includes a nursing home, clinic, medical centre, medical or teaching institution for therapeutic purposes and other like institution" (section 2(g), Transplantation of Human Organs and Tissues Act, 1994).

The width of the word. The definition is inclusive. A small clinic and a large teaching hospital are both "hospitals". So every place where an organ is removed, stored or transplanted falls within the Act.

Why the definition matters: registration. "No hospital (including Human Organ Retrieval Centre) shall commence any activity relating to the removal, storage or transplantation" of any human organ or tissue unless it is "duly registered under this Act" (section 14(1)). The Appropriate Authority registers it only if it has the specialised services, skilled staff and equipment prescribed (section 14(3)). Since 2014 it must also have appointed a transplant coordinator (section 14(4)).

Its control. The Appropriate Authority may suspend or cancel the registration for a breach (section 16). Removal of an organ by an unregistered hospital is itself unlawful. In Kuldeep Singh v. State of Tamil Nadu, (2005) 11 SCC 122, the Supreme Court explained that the Act's foundation was "the shocking exploitation of abject poverty of many donors".
